On November 24, 2022, the Government of B.C. implemented new legislation eliminating age restriction bylaws in the province with exemptions for buildings restricted to residents aged 55 and over.
More recently, the government announced additional exemptions to the permitted 55+ age restriction to be mindful of the following:
Live-in caregivers of the resident are not bound by the age restriction;
Those under the age of 55 who resided in the unit before the age restriction bylaw was passed are permitted to remain;
Effective May 1, 2023, an owner or tenant with a legacy exemption can also have their spouse, partner, or children live with them at any time after the bylaw was passed regardless of their age;
Effective May 1, 2023, certain residents may have their child of any age live with them; and
Effective May 1, 2023, spouses of persons living in a “marriage-like relationship” may live with the owner or tenant regardless of their age.
